Terms & Conditions of Hire  

 

Please ensure that the following safety instructions are followed Once the inflatable is set up, the safe operation of the inflatable becomes the hirer’s (person who signs this form) responsibility and they must ensure that all possible steps are taken to avoid people injuring themselves and damage to the inflatable. Please ensure the following safety instructions are adhered to.
1. All inflatable's have age limits (on the reverse of this form) please ensure no-one over this age uses this equipment.
2. No food or drink allowed on the inflatable.
3. All shoes, hats, badges and jewellery (large earrings, necklaces etc.) MUST be removed, it is also recommended that spectacles are removed.
4. Socks must be worn.
5. No smoking on or near the inflatable and BBQ's.
6. If safety equipment is supplied with the inflatable (helmets etc.) this must be worn at all-time whilst on the inflatable.
7. Climbing, hanging or sitting on the walls/sides of an inflatable is DANGEROUS and is not allowed.
8. A responsible adult must supervise the equipment always.
9. Ensure the inflatable is not overcrowded. Limit the number of people using the inflatable. If adults or children are colliding into each other, then it is too crowded. Try to limit large children and small children using the inflatable at the same time.
10.DO NOT allow anyone to bounce on the front/entrance step; this is only there to help users get on and off the equipment safely.
11. Ensure anyone who is pregnant, has a medical condition or suffers from back/neck problems does not use the equipment.
12. NO-ONE is allowed on the equipment during inflation or deflation.
13. Safety mats are there for a reason, please do not move these away from the equipment. (Sumo suits are only to be worn whilst on the safety mat provided)
14.ALL PETS MUST be kept away from the inflatable at all times.
15. NO face-paints, party-poppers, coloured streamers or ‘silly string’ must be used when on or near the inflatable.
When the equipment is collected please ensure it is in the same condition as when it was delivered. (A cleaning charge will be required if any of these conditions are not met.)

In the event of heavy rain please DO NOT use the inflatable. Any wetness, including bubbling can be dried with a towel. A small picnic table (if available) placed over the fan/blower will prevent water being sucked into the inflatable.

The person/organiser hiring this equipment will be responsible /liable for any damage or injury occurring from or as a result of misuse or reckless use.
These safety guidelines are here to ensure the safety of both people using the Equipment and our inflatable’s, it is the sole responsibility of the hirer to ensure these guidelines are adhered to.
We cannot be held responsible for any underground services damaged by stakes.
Our company cannot accept any responsibility for any injury caused to anyone using this equipment whilst under the hirer’s supervision.
The hirer understands that if there is any damage to or loss of the Equipment they will be responsible for the cost of repair or replacement of the equipment.
2 forms of identity must be provided with payment on delivery. (If paying by cheque you must have a cheque guarantee card present.)

You hereby agree to abide by the terms and condition set out on this hire contract and safety sheet.

Company Terms and Conditions of Booking

 

These are in addition to our standard hire contract form’s (If the Hirer is in any doubt as to the meaning of the following, a representative from Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK should immediately be consulted).

Definitions 1.1 The “Client” means the person/s, organization or company booking the equipment, act or entertainment with the “Company”.  1.2 The “Company” means Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK 1.3 ‘Dry / unmanned’ hire is the hire of equipment for the ‘client’ to operate and supervise themselves. 1.4 ‘Wet / supervised’ hire is the hire of equipment or entertainment accompanied by a representative of the ‘company’ to supervise use of the booked equipment or entertainment.

Bookings 2.1 All equipment remains the property of the company at all times.
2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our contract terms and conditions of hire.
2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.

Prices, Deposit & Balance Payments 3.1All hires up to £200 are subject to a deposit of 25%. All hires over £200.00 are subject to a deposit of 50% (Deposit is non-refundable, unless due to unforeseen circumstances on the day of the booking).  3.2 The balance to be paid in full by cash, credit card 4.5% surcharge or debit card £1.50 surcharge upon delivery or prior to the event. If payment is to be made by cheque then it must be sent and cleared 14 days prior to the event start date unless approved account facilities are held of which written credit terms would be given to the client a minimum of 28 days prior to the event. 3.3 Terms for approved account clients will be strictly 14 days from invoice date unless agreed in writing by the company. 3.4 Advertised prices are subject to change without prior notification. 3.5 The company reserves the right to charge interest on all overdue accounts – at LIBOR + 8%. 3.6 The company reserves the right to charge a late payment fee of: - £40 for up to £1000, £70.00 for £1000 to £10000 and £1000 thereafter on all unpaid invoices. 3.7 All cheque payments which are none honoured will be subject to an additional charge of £25.00. 3.8 The company reserves the right to recover all legal & admin costs incurred. 3.9 All prices are subject to V.A.T at the current rate, unless otherwise stated.

Cancellations 4.1any cancelled orders under £200 are subject to the following cancellation charges: More than 7 days prior to the event date, there is no cancellation charge. Within 7 days of the event date, 50% of the contract total unless we can hire out the equipment elsewhere. Within 1 day prior to the event date, 75% of the contract total. On day of the event, 100% of the contract total. 4.2 Any cancelled orders over £200 are subject to the following cancellation charges Within 8 weeks prior to the event date 25% of the contract total Within 4 weeks prior to the event date 50% of the contract total Within 2 weeks prior to the event date 100% of the contract total.  If cancellation is due to bad weather (e.g. heavy rain or high wind) for outdoor events – (to be determined by the company or by our on-site delivery team when they arrive or manager) on the day, then there is no charge providing we have not taken inflatable/s out of the van/s or left the delivery depot if your event is outside Nottinghamshire area for bookings and orders £100.00 or under, for all other bad weather cancellations of £101.00 and over the above cancellation fees applies or you move your booking to another date subject to our equipment being available.  Please Note we use BBC weather web site for weather information. Cancellations or changes in booking must be notified in writing and will only be accepted from the franking date of the envelope upon receipt at our offices.

Equipment 5.1The Company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment. 5.2 All sizes quoted are approximate 5.3 all goods remain the property of the company at all times. 5.4 The company reserves the right to amend or alter any product specifications without prior notice.

Site Location, Facilities & Conduct 6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded and set up, unless by prior agreement. 6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable or due to insufficient space to install the equipment by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs/steps or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full contracted fees will be due to the company. 6.3 The client is responsible for ensuring that suitable security, first aid cover and crowd control measures are in place prior to start of event. 6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. At no time will any level of abuse against our staff be tolerated. In all such cases no refund will be given and full contracted fees will be due to the company. 6.5 If the client wishes to charge their guests to use the equipment, they must provide a person to do so. At no time will our staff apart from dealing with the contract balance handle any other monies on the event unless agreed in writing prior to the event.

Liability & Insurance 7.1the Company’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company). 7.2 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire. 7.3 The company accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment. 7.4 Any equipment booked on ‘dry hire’ (not supervised by a representative of the company). Is not covered by the company’s insurance policy and the client is responsible for suitable insurance cover if it is required.

Damages 8.1If any of the hired equipment, accessories, vehicles or trailer(s) is damaged or lost during the period of hire any security deposit paid will be utilized in discharge of or in part payment for repairs/replacements or lost hire contract’s. The Hirer shall indemnify Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK for the full cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring as a result of the hiring. If the hirer has made payment by credit or debit card then Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK reserves the right to make a charge to the credit or debit card used to make payment for the hire of the equipment, or to send an invoice for the amount to the registered hire address on the contract, should payment not be received as per the invoice sent then we reserve the right to take legal action and all costs will be passed on to the hirer. The company’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company).

Miscellaneous 9.1THE HIRER will, during the period of the hiring, be responsible for the supervision of the equipment (unless supervision is provided by Merlin Inflatables and Entertainments UK), its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity, including proper supervision of children to ensure children under school age use the equipment separately to older children or adults. The Hirer acknowledges that they have read and understand any relevant operating and safety instructions supplied with the equipment. Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract. 9.2 IN ALL HIRING CONTRACTS a refundable security deposit in the form of cash; cheque, credit or debit card may be required. Such deposit will be returned to the Hirer after 72 working hours of return of the goods & inspection, unless the hired equipment, any accessories or trailer(s) have been damaged or lost during the period of hire and in such circumstances the said deposit will be utilized in discharge of or in part payment of those repairs/replacements or lost hire contracts. The Hirer shall indemnify Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK for the full cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring as a result of the hiring. 9.3 THE HIRER shall not use the equipment for any purpose other than that described in the hiring agreement, and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way, nor allow anyone onto the equipment wearing shoes, spectacles, carrying sharp objects, key-rings, metal studded clothing or any other similar items which could cause damage to others or the equipment. No food or drink is to be consumed on the equipment. The hirer should not use the equipment outside in the event of high winds or very wet conditions must locate the equipment on flat ground and satisfy him that there are not dog messes or any sharp objects on the ground which may damage the equipment. The unit must also be suitably anchored at all times. 9.4 THE HIRER is responsible for ensuring that adequate safety barriers and notices are fitted around equipment if required. All equipment must be used in accordance with the HSE Guidance Note PM76/ Entertainment Sheet No 7, all operating instructions issued by Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK verbally or in writing and in a suitable safe environment. Any equipment hired for use on licensed premises shall be operated in a fenced off, glass free area. Notices indicating that the area is a GLASS FREE ZONE will also be required. 9.5 THE HIRER is required to provide access to a working and tested 240-volt 13amp power supply within 25 meters of the site. Each separate inflatable booked will require its own connection from the inflatable to the 240-volt 13amp wall socket. If the unit is hired with a generator, the additional charge made is for the hire of the generator and is supplied on the basis of being fuelled with one tank of fuel, any additional fuel with be charged for. 9.6 THE HIRER will provide the following site conditions. A level site for all equipment supplied, a minimum access width of 36 inches (or more for larger equipment – Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK will notify you of this on booking), ensure that the site is free from all debris, sharp objects, animal waste (if animal waste is found then Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK will charge for the ground sheet used and this will then become your property at the end of the said hire or refuse to hire the equipment and full payment is due) and within 50 meters of the delivery vehicle. If the site is outside of this distance, Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK reserves the right to cancel the booking and invoice the client for the agreed contracted price. 9.7 IF ANY UNIT is unable to be collected outside the hire period for whatever reason an additional charge of £50.00 per day, daily hire charge or lost hire contracts whichever shall be the greater, will be payable by the Hirer to Fairwood Entertainments UK Ltd T/A Merlin inflatables and Entertainments UK for each day or part day until the unit comes into the possession of Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK. 9.8 IN ALL HIRING CONTRACTS the Hirer or their agent when will be required to produce proof of their identity and address. This will only be accepted in the form of Driving License, Utility Bill (dated within 3 months, mobile phone bills not accepted) or Passport. 9.9 THE HIRER shall be deemed to have inspected the equipment, (accessories and trailer(s) if supplied) and to have agreed that it is supplied in good condition unless he brings to the attention of Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK once setup and doing a walk-round inspection with a Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK employee and any faults noted by the Hirer upon the reverse of the hire contract. Any fault not reported within this time will be deemed to be the responsibility of the hirer. 9.10 FOR EQUIPMENT delivered to site, any delay with regards to meeting the client after the contracted arrival time will be charged at an additional £15 per fifteen minutes waiting time incurred. This will be rounded up to the nearest fifteen minute time period. Should we have to leave to fulfil our other delivery commitments and then return then there will be a re-delivery charge applied. 9.11 PUBLIC LIABILITY INSURANCE is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol. 9.12 IN THE EVENT of an accident occurring, full written details must be recorded including, name and address of injured party, circumstances of accident, date and place of incident and a copy of the report to be sent to Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK. 9.14 AT THE END of the hiring the Hirer shall be responsible for leaving the equipment in a clean and tidy condition otherwise Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK shall be at liberty to make an additional charge. If the Hirer fails to return the equipment in a clean and tidy condition Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK are entitled to levy a further charge of £50.00 per unit per hour or part hour for the cleaning and servicing of the equipment, and any loss of hire costs. 9.15 IN THE EVENT of the equipment or any part thereof being rendered unfit for the use for which it has been hired, Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK shall not be liable to the Hirer for any resulting loss or damage whatsoever. Any refund offered for unusable equipment will be entirely at the discretion of Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK will be made in writing before any payment will be made. 

Voucher - Coupon Terms & Conditions

No cash alternative, cannot be exchanged for cash either in full or part. We reserve the right to cancel or vary this offer without notice. Photocopies not accepted, voucher or coupon is non-transferable and cannot be applied after purchase or after time of delivery, must be handed to our delivery team when hire is paid for. Voucher or coupon is valid until date printed on the voucher and cannot be redeemed after this date. Voucher cannot be replaced if lost or damaged. Cannot be used in conjunction with any other offer or promotion, also only applies to Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK inflatable’s and equipment only, not applied to any sub hired or sub contacted equipment. Can only be used once and must be handed to delivery team when paying for hire or equipment. Cannot be redeemed by Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK staff or family members. Cannot be used at same time as any other voucher or coupon, one voucher or coupon per day per transaction. Voucher or coupon only valid when front is overprinted and validated by Fairwood Entertainments UK Ltd T/A Merlin Inflatables and Entertainments UK.
